Which Enterprises are Exempt

There are some companies that are excused from the requirement to carry workers’ compensation insurance. But when a company that is subject to the law does not meet its obligations, then it may be appropriate to pursue a case for workers’ compensation fraud. Before doing so, however, it is important to bear in mind which businesses are exempt, including the following:

  • Agricultural operations with fewer than 10 regular, non-seasonal employees
  • Sole proprietorships, partnerships, estates, and trusts with fewer than 3 workers beyond executive and titled members of organization
  • Corporations with fewer than 3 workers including corporate officers
