Indiana Workers’ Comp Falls to Employers
In Indiana, a fire fighter was injured on the job in March 2005. The treatment he received was billed at $11,563 and the workers' comp insurer hired a billing review service to check into the charges. That service recommended paying only $5,104.
As a result, the case was taken to the Workers' Comp Board for the remaining amount, and from there it went to court. In an Indiana Appeals Court, the judges ruled that hospitals are not responsible for proving charges but employers are responsible for proving whether they are responsible for less than the billed amount.
