OSHA fines Ft. Bragg for 37 safety violations

The Occupational Safety and Health Administration recently issued a Notice of Unsafe and Unhealthful Working Conditions to the U.S. Army after finding 37 workplace safety violations at Fort Bragg.

Executive Order 12196 requires federal employers to meet the same workplace health and safety standards as private employers.

Director of the OSHA Raleigh Area Office Kim Morton stated, “Civilian employees and contractors working to support our soldiers should not have to risk their own safety and health daily by being exposed to the hazards found at Fort Bragg.”

Violations included 2 repeated safety violations, 14 serious safety violations, 3 serious health violations, 17 other-than-serious health violations, and 1 other-than-serious safety violation.

Amount of people receiving workers’ comp dropped by 4.4% in 2009

A report from the National Academy of Social Insurance says that the amount of people in the United States covered by workers’ compensation decreased by 4.4 percent during the economic recession.  In 2009, the number of people receiving workers’ compensation insurance decreased to 124.9 million.

The report, “Workers’ Compensation: Benefits, Coverage, and Costs, 2009,” says the recession caused the greatest decline in workers’ compensation benefits in 20 years.  However, benefits paid increased slightly from 2008 to 2009 with a .4 percent increase to $58.1 billion.

In addition, total employers’ workers’ compensation costs decreased to $73.9 billion.  The 7.6 percent decrease was the largest drop in workers’ compensation costs paid by employers in the U.S. since 1987.

Sysco Guest Supply fined $12,550 in fatal accident

Last month, the North Carolina Department of Labor fined Sysco Guest Supply in Concord, North Carolina $12,550 for workplace safety violations that led to the death of an employee.

The accident occurred in late March when a 47-year old warehouse supervisor fell from a storage rack at the company’s facility.  The worker attempted to stabilize himself on a pallet of paper napkins before falling 19-feet.

Investigations into the company began in April after the fatal fall accident.  The company was cited with four serious workplace safety violations.

Violations included working on racks without proper fall protection, riding on the forks of a forklift, leaving a lifted forklift unattended, and failure to evaluate fork lift operators every three years.

House approves changes to workers’ comp

Today, members of the North Carolina House of Representatives approved changes to the state’s workers’ compensation in a 106-8 vote.  The bill is scheduled to have a final vote tomorrow.

According to the legislation, workers’ compensation payments would be limited to a little less than 10 years for completely disabled workers.  In addition, the legislation would increase the maximum time that partially disabled workers are able to receive workers’ compensation.  Lastly, the bill increases death benefits.

There are some exceptions to the cap for completely disabled workers, such as workers with very severe or specific injuries.  For example, amputations or paralysis.

Pending House Bill could limit workers’ compensation

A bill to reform workers’ compensation laws in North Carolina, House Bill 709, is seeing opposition from many over the limitations it would put on injured workers.  Representative Dale Folwell introduced the bill yesterday and is mainly seeing support from large companies and insurance providers.

Just some of the changes the bill would make, if approved, include: cutting off benefits to workers after 9 years, eliminating a worker’s choice of doctor or medical professional, and giving employers, insurance companies, and their attorneys access to a worker’s medical records.

Currently, the bill is believed to be using biased research and statistics.  Findings used as evidence in support of the bill are said to have been obtained from a non-random sampling of 16 states picked by the bill’s backers.

Worker killed in Wilmington plant explosion

Earlier this month, a technician working at the Progress Engery plant in Wilmington, North Carolina was killed in a tragic explosion at the coal-fired plant.  Progress’ Sutton plant has 3 coal-fired units that produce 600 megawatts of electricity.

According to officials, the explosion occurred at around 9 A.M. at a generator that had been shut down for maintenance.  The plant explosion did not cause a fire and did not endanger the public.

State and federal officials are investigating what caused the explosion that left 24-year old Cory Rogers dead.

Our utmost sympathies go out to Rogers’s family and friends.

High Point Fire Department fined by DOL

The North Carolina Department of Labor recently issued several fines to the High Point Fire Department concerning safety violations at the department.  Total fines came out to $81,300.

Investigators determined that the fire department had committed 16 violations against North Carolina’s Occupational Safety and Health Act.  Investigations into the department began in September 2010 because fire fighters at High Point issued complaints.

The safety violations concern deficiencies in fire fighter training and poor equipment maintenance.  None of the violations found by investigators were willful safety violations.  Officials from High Point will meet with the city and the Department of Labor to discuss how to best resolve their issues.

Workers’ comp reform bill could cut benefits

A new workers’ compensation bill will soon be introduced to the North Carolina General Assembly that would cut some workers’ compensation benefits for injured workers.  In addition, the bill proposes that the cost of workers’ compensation insurance be shifted from employers to taxpayers.

Furthermore, if approved, the bill could possibly cut workers’ compensation benefits off to people who have received them for 9.5 years.  This would include those with permanent disabilities, are paralyzed, and those who will never be able to work again.

In North Carolina, public opinion reveals that voters do not support workers’ compensation reform or limiting benefits to injured or disabled workers.  In a poll of North Carolina residents, 66 percent said that they did not approve of a 9.5 year limit to workers’ compensation benefits.

DOL asks NC businesses to apply for safety award

This week, the North Carolina Department of Labor announced that they are accepting applications from businesses in North Carolina for workplace safety awards.  In order for a business to qualify for a safety award, they must have no fatalities at the site they are using on their application.  In addition, businesses must have an injury and illness rate at least 50 percent lower than the average rate in their industry.

“A safety award shows employees and the community that you are committed to safe work environment.  A good safety record is something to be proud of, and businesses deserve to be recognized for their efforts,” stated the Department of Labor’s Commissioner, Cherie Berry.

Workplace fatalities increase in 2010

In 2010, there were a total of 48 fatalities in North Carolina workplace accidents.  In 2009, there were 34 workplace fatalities in the state.  According to the North Carolina Department of Labor, while workplace fatalities increased in 2010, injuries and illnesses reached an all-time low in the private industry.  80 percent of workplace fatalities occurred because of 4 main types of hazards.  ”Struck-by” accidents resulted in the highest amount of fatalities with 16 in 2010.  Falls accounted for the second highest amount of 15.  In addition, 4 workers were electrocuted and 9 died from being crushed by objects.

“Any workplace death is a tragedy and of great concern because it affects so many people- the family, the co-workers, the community and our department.  We’ll redouble our efforts and work even harder to prevent these accidents from happening, and we’ll call on employers and employees across the state to recommit themselves to workplace safety and health in 2011,” said Labor Commissioner Cherie Berry.
