OSHA asks retailers to protect employees on Black Friday

Posted on November 21st, 2011 No Comments

This coming Friday, the day after Thanksgiving, is Black Friday.  Accordingly, retailers across the country will be opening early and offering huge sales for consumers looking to get started on their holiday shopping.

Last Thursday, officials with the U.S. Occupational Safety and Health Administration issued a statement encouraging retailers to implement plans that will protect their employees from being injured on the job.  In particular, the agency recommends that retailers come up with crowd management strategies.  On Black Friday in 2008, a retail store employee was killed when a mob of shoppers rushed the store and he was trampled.

The statement included a tip sheet which suggests using an online lottery for more desirable items to prevent crowd rushing or fights among shoppers, implementing additional communication systems like using bullhorns, and designating certain workers to call 9-1-1 in the case of an emergency or injury.

Workplace injuries up in healthcare industry

Posted on November 15th, 2011 No Comments

According to the U.S. Department of Labor’s Bureau of Labor Statistics, workplace injures in the healthcare industry are increasing.

Last year, nonfatal injuries and illnesses to attendants, orderlies, and nursing aides increased by 7 percent with approximately 489 incidents per 10,000 workers.  Support workers in the healthcare industry experienced a 6 percent increase in injuries and illnesses to a rate of about 283 incidents per 10,000 workers.

The highest increase was in musculoskeletal disorders among healthcare workers.  The rate of these injuries among healthcare workers increased by 10 percent with 249 incidents per 10,000 workers.

The average injury and illness incident rate for workers in the U.S. workforce is approximately 118 incidents per 10,000 workers.

OSHA Assistant Secretary David Michaels stated, “It is unacceptable that the workers who have dedicated their lives to caring for our loved ones when they are sick are the very same workers who face the highest risk of work-related injury and illness.”

OSHA lists top 10 safety violations

Posted on November 8th, 2011 No Comments

Last week, the U.S. Occupational Safety and Health Administration released a list of the top 10 safety violations at workplaces in the U.S.

According to the list, the most frequently committed safety violations have to do with fall protection.  OSHA revealed that last year they issued 7,139 citations involving fall protection safety.  In addition, the agency says that 260 workers died in accidents involving violations in fall protections in the U.S. in 2010.

Second on the list is scaffolding violations.  These types of violations topped last year’s list and accounted for 7,069 citations from OSHA in 2010.  Also included in this year’s list of top safety violations are respiratory protection, hazard communication, lockout/tagout, ladders, wiring, electrical, powered industrial trucks, and machine guarding violations.

Construction worker killed in 3-story fall in Charlotte

Posted on November 3rd, 2011 No Comments

Last week, a construction worked died in a construction accident in Charlotte at the Pike Energy Solutions facility.

The accident occurred at around 8 a.m. when the worker was doing work on the building’s roof.  Police report that the worker and a garbage chute on the top of the building fell 3 stories from the roof.  The worker landed in a large dumpster and suffered serious, life-threatening injuries.

Investigators are currently unsure of what caused the worker and the garbage shoot to  fall.  Reports do not indicate whether federal investigators with the U.S. Occupational Safety and Health Administration will be involved in the investigations into this fatal construction accident.

Paramedics arrived at the scene and tried to revive the worker, but his injuries were too severe and he was pronounced dead at the scene of the accident.

Our thoughts and prayers are with the victim’s family and friends.

Economic troubles increase workplace stress, injuries

Posted on October 25th, 2011 No Comments

According to a recent survey, 62 percent of workers in the U.S. feel that their employer is trying to do more work with fewer resources after the economic recession.  Researchers call this “worker intensification” because employees are being asked to do more with fewer resources, in less time, and for the same amount of pay.

55 percent of workers have taken on more responsibilities after the recession and 70 percent of these have done so without an increase in pay.  In addition, 51 percent of survey participants reported that their added responsibilities at work have had a negative effect on their well-being.

The survey also says that as workplaces become more stressful, conflict between employees increases and employees experience a greater inability to concentrate and do their job to the best of their ability.  Furthermore, workplace stress leads to a greater number of employees taking sick leave and an increase in workplace accidents and injuries.

40th Anniversary of OSH Act

Posted on October 17th, 2011 No Comments

This year is the 40th anniversary of the passing of the Occupational Safety and Health Act which created with Occupational Safety and Health Administration.

Before the Occupational Safety and Health Act, workers were not entitled to a safe and healthy workplace and would have to find other work if they were unsatisfied with their job’s working conditions.

President Obama recently said in an address to Congress, “what we can’t do … is let this economic crisis be used an excuse to wipe out the basic protections that Americans have counted on for decades.  I reject the idea that we need to ask people to choose between their jobs and their safety.”

40 years ago, the National Safety Council estimated that 38 workers died on the job every day.  Today, officials estimate that 12 workers die on the job every day in a workforce that is twice the size of the workforce in 1971.

Legislators debate OSHA roofing regulation

Posted on October 12th, 2011 No Comments

Last week, legislators in the U.S. House of Representatives were reported to be debating the Labor Department’s Occupational Safety and Health Administration’s regulations.

The focus of the debate was on a new regulation that requires roofers to use use safety harnesses in residential projects.  Head of OSHA David Michaels was asked to give a presentation to a House of Representatives subcommittee on the reasons for the new regulation, as well as a few other recent regulations.

While many legislators agree that the regulation will reduce workplace injuries and fatalities, others say it is not worth the cost and red tape it creates.  Michaels described OSHA’s regulations as “vitally important” in his appearance before the House subcommittee.

Lyme disease treatment is controversial

Posted on October 5th, 2011 No Comments

Medical researchers and experts are still unsure of exactly what treatment is best for patients with Lyme disease.  Many doctors say patients should only undergo 1 round of antibiotics, while others say patients should stay on antibiotics until symptoms disappear.

Lyme disease is transmitted by deer tick bites.  Symptoms of Lyme disease include a red rash, fever, fatigue, chills, muscle and joint pain, and headache.  If an individual with Lyme disease does not receive treatment for the infection, they cold develop heart palpitations, facial palsy, and spinal cord inflammation.

Typically, doctors only give patients who test positive for Lyme disease antibiotics for a few weeks.  Researchers at UTHealth’s infectious diseases department also say that using antibiotics long-term does not seem to help.

Most doctors recommend antibiotics for only up to 6 weeks.  However, the U.S. Centers for Disease Control and Prevention says that between 10 to 20 percent of patients with Lyme disease experience symptoms of the infection years later.

Boulder falls off equipment and onto worker

Posted on September 28th, 2011 No Comments

Yesterday, a contractor was injured when a boulder fell off of the construction equipment he was using and rolled back onto him.   Reports indicate that the contractor was working at a construction site in Charlotte at East Charlotte and Robinson Church Road when the accident occurred.

The contractor was using a Bobcat construction vehicle to lift a boulder when it fell off the machine’s scoop and rolled back onto the vehicle.  The worker was trapped in the Bobcat, but fortunately he was able to use his cell phone to call 9-1-1.

Emergency crews removed the boulder, which was resting on top of the worker’s lap, and extricated him from the construction vehicle.  He was taken to Carolinas Medical Center University for treatment of minor injuries.

Officials with the Occupational Safety and Health Administration are investigating the accident to determine a cause.

Occupations with highest rates of occupational disease

Posted on September 21st, 2011 No Comments

A data analysis company recently reviewed statistics from the Bureau of Labor and Centers for Disease Control and Prevention to determine what are the most common occupational diseases and in what professions workers are the most likely to become ill.

The most common types of occupational illness were found to be lung disease, heart disease, and cancer.  In addition, researchers found that morticians, coal miners, welders, concrete mixers, pipefitters, firefighters, and pilots were the most likely to contract occupational diseases.

In July, officials declared formaldehyde a carcinogen.  Because morticians often work with formaldehyde, they are more likely to develop leukemia than workers in other professions.  Concrete mixers are at risk of developing silicosis — a lung disease caused by inhaling silica dust often found in concrete.

Coal miners are the most likely to suffer from pneumoconiosis, or black lung disease, and pilots are at risk of developing melanoma from prolonged sun exposure.

If you or someone you love has developed an occupational disease as the result of unhealthy working conditions, contact the Raleigh occupational disease attorneys of Scudder & Hedrick, PLLC at 919-851-3311 to learn more about how we can help you file for workers’ compensation.
