TIMCO employee falls to death in Greensboro

A long time TIMCO employee, died last month in a tragic manufacturing accident at the company’s Greensboro, North Carolina facility.

41-year old Preston Strickland was working on a plane about two stories tall at TIMCO’s Aviation Services when he fell off the plane.  Strickland was pronounced dead at the scene.

Strickland worked for TIMCO for sixteen years and was an honored veteran of Operation Desert Storm.  ”We are truly heart-broken at this terrible and devastating loss.  Our thoughts and prayers go out to his immediate family and to all of his extended family and friends,” stated TIMCO President and CEO, Ron Utecht.

Officials are investigating exactly what caused this terrible accident.

Rodney Rogers creates charity for disabled

The former Wake Forest player and NBA Sixth Man of the Year, Rodney Rogers recently created the Rodney Rogers foundation for paralyzed and wheelchair-bound people.

Rogers broke his neck and became paralyzed from the neck down after a dirt bike accident in 2008.  Doctors say he has about a five percent chance of recovering but Rogers still hangs onto hope.  ”I hope and pray that in the near future, I’ll get my arms back, and then hopefully my legs,” stated Rogers.

Rogers and his wife created the foundation for “charitable, scientific, and educational purposes to help families with a paralyzed or wheelchair-bound person in need”.

Rogers understands that the cost of being paralyzed is extremely expensive.  His wheelchair cost over $80,000, nursing care can cost up to $60,000 a month, not to mention medication, transportation, and other amenities.  For these reasons, Rogers created the foundation and will be making speaking appearances in hopes of inspiring others in similar situations.  The funds raised will go towards “providing financial and emotional support to those dealing with paralysis”.

NC DOT employee dies in accident

A North Carolina Department of Transportation employee died Wednesday June 2nd in a tragic accident off a work-zone along I-40.

DOT employee, 21-year old Jonathan King, was hit by a tractor-trailer while setting up a work-zone along I-40 in Dublin County. Officials say the driver of the tractor-trailer took his eyes off the road for a second and swerved off the road, hitting and pinning King between two vehicles.

King is the first employee the North Carolina DOT has lost in a workplace accident in three years.  One other employee was injured in the accident, but has been released by the hospital. The driver of the tractor-trailer is facing charges of misdemeanor death by motor vehicle and several other charges.

DOT supervisor Rodney Poe stated that the biggest difficulty is trying to get drivers to slow down when driving through construction zones.

Trapped NC construction worker rescued

This Monday a construction worker from North Carolina was rescued after being trapped 30 feet inside a tunnel on the University of Tennessee campus.

The 27-year old man, whose identity has not been released, was working for Blount Excavating Inc. of Maryville on excavating a horizontal channel for a sewer line on UT’s future Sorority Village.  While working, the man was trapped by an auger, or large drill, 30 feet inside the channel.  His leg was caught between the drill’s blades and the wall of the tunnel.

Officials said the man was taken to the UT Medical Center with serious leg injuries.  Circulation to the man’s leg was cut off for about an hour before he was rescued, and workers worried his femoral artery might have been cut by the drill’s blade.

Raleigh County third in state for workers' comp

The school board and officials of Raleigh County recently stated that the county currently ranks third in the state for workers’ compensation costs.

The school board is now working to cut these costs and plan financials for 2011. The board passed a new budget this Wednesday estimating the school year budget for 2011 to be $125 million.

Board member Larry Ford stated, “Every $100,000 workers’ compensation claim- that could be another teacher or two”.

The county has recruited Wells Fargo to help lower their workers’ compensation costs, while still maintaining its insurance company, BrickStreet.

The county is also considering hiring a new safety director position.

Construction Accident at UNCG Injures Two

Two demolition subcontractors were hospitalized on Wednesday, May 26 after an accident occured while working at the University of North Carolina Greensboro campus.

Construction began on the Foust and Guilford residence hall this May as the spring semester ended and students left for summer.  Renovations were set to include refurbishing bathrooms, replacing windows, and upgrading the fire alarm system.

Unfortunately during the construction of these renovations, two men were injured after part of the first floor celing of Mary Foust Hall collapsed.  The men, who were working with Clean Air Environment, were rushed to the hospital by Guilford County EMS and fire officials around 3 PM with injuries to the legs and back.

Workplace Standards for Biotech Industry Questioned

Biotechnology labs involve a growing number of risks for employees and possible injury.  With advances in science and technology, many critics say the biotechnology industry has far too little regulations preventing hazardous conditions.  These beliefs are confirmed by the head of the federal Occupational Safety and Health Administration’s opinion that their 20th-century standards have not caught up to the 21st-century reality of the biotech industry.

“Worker safety cannot be sacrificed on the alter of innovation.  We have inadequate standards for workers exposed to infectious materials” stated David Michaels, director of OSHA.

In order to try and change this, OSHA began acquiring information on the negative effects working with infectious agents.  From 1979-2004, there have been nearly 1,500 symptom causing infections in biotech laboratories, 36 of which resulted in death.  Around half of these cases occurred in research laboratories, and the other half in diagnostic laboratories.

In a recent case, former microbiologist Becky McClain working at the pharmaceutical research center for Pfizer, sued the company after suffering from temporary paralysis due to infection from one of their genetically engineered viruses.  Ms. McClain questioned the company’s safety conditions and claims this as the reason for her eventual firing.  Last month, the jury supported her fight and awarded her $1.37 million.

Massachusetts approves worker's compensation insurance cost decrease

Massachusetts lawmakers approved a 2.4 percent decrease in workers’ compensation insurance costs this week, to go into effect starting September 1. The money saved through this should amount to around $22.5 million.

The decrease marks the tenth rate reduction in the Bay State since 1994.

“Lowering the cost of workers’ compensation insurance is very much in keeping with our larger goal of improving the state’s business climate so that we can grow the economy and create jobs,” Gov. Deval Patrick said.

Paul Meagher, president of the Workers’ Compensation Rating and Inspection Bureau of Massachusetts, disagrees. The organization had lobbied for 4.5 percent increase in rates prior to the passage of the new rate decrease.

“In today’s uncertain economic climate, maintaining a healthy voluntary market for workers’ compensation insurance will likely be a challenge given the continuing increase in claims severity and low expected industry investment returns,” he said. “The WCRIBMA is committed to working with its committees, members, regulators, and other stakeholders toward our shared goal of a stable and healthy workers’ compensation market in the Commonwealth,” Meagher said.

Compensation bill passes OK House

The previously proposed Oklahoma legislation to overhaul workers’ compensation recently passed in that state’s House of Representatives. Senate Bill 1973 will change the current compensation legal system by removing two of the judges from the court, taking the total number from ten to eight. Additionally, these judges will be limited to a single term of six to eight years, although current judges will be offered a single reappointment for an eight year term.

The legislation, if passed in the Senate, will define “major cause” in compensation cases. Also, it will exempt employers from injuries suffered outside employment, removing liability from them in these situations.

The legislation passed through the House with a 64-33 vote, and came through without an additional amendment that would have entirely dismantled the previous Workers’ Compensation Courts system, and simply ran all cases through the district civil courts.

Oklahoma state legislators were optimistic about the law’s potential to help employers through a tough economic period and, over all, smoothen the entire process for everyone involved.

Indiana Supreme Court Sides With Farmers in Workers' Comp Lawsuit

The Indiana Supreme Court has ruled that an insurance company was wrong in denying coverage to an injured employee of an independent contractor under a farm personal liability policy.

According to court documents, Indiana farmers Rick and Katrina Taylor held a farm personal liability policy issued by Everett Cash Mutual Insurance Company and filed for coverage of injuries sustained by an employee of an independent contractor that was hired to paint a house, grain bin, and barn on their property. The Taylors sued Everett Cash for breach of contract after the company denied the claim citing an exclusion for workers’ compensation in the liability policy.

The court explained the case in its decision saying “on July 1, 2005, the Taylors employed independent contractor Sherlock Contract Painting… While painting, Sherlock employee Christopher Collis sustained injuries when he was shocked by an electrical wire and fell from a ladder… Collis filed a workers’ compensation claim against Sherlock.”

The court denied Everett Cash’s request for a summary judgement.
