Construction worker killed in stairway accident

A construction worker was killed on the job at Sugar Camp Mine while installing a steel stairway. The worker was working at the mine as an employee of an independent construction company. According to the county coroner, the construction worker was working with heavy steel stairs when they came loose and hit him in the chest. He died on the scene.

Less than a year ago, another deadly accident occurred at the same mine. A worker was pouring concrete near an opening in the ground when he took a wrong step and fell 40 feet.

Oklahoma considers new worker's comp overhaul

An Oklahoma State Representative filed an amendment to Senate Bill 1973 last week that could result in a complete overhaul of the current worker’s compensation protocols for the state.

The amendment, suggested by Rep. Ken Luttrell, should be considered in the House sometime this next week and if passed would require that all worker’s compensation claims in the state be sent to district civil courts.

“These are local claims involving local employers and local workers – so why should all those individuals have to travel to Oklahoma City or Tulsa to have a case heard?” said Luttrell. “I have faith in our local courts to handle these issues fairly.”

This system, if approved, will be unique to Oklahoma amongst the 50 states.

Workers' compensation questioned after hug

A Wendy’s restaurant in Arkansas attempted to deny workers’ compensation to an employee because it claimed she was not performing work-related duties when she fell. The employee had clocked out and was walking toward the door when she stopped to hug a co-worker. After the hug, she stepped away and immediately fell. She sustained a knee injury that required surgery, followed by physical therapy.

The state Court of Appeals overturned the ruling, stating that the hug, a deviation of employment services, was already completed when she fell, and that she returned to employment services as she then attempted to leave the building.

UIC Study: Chicago Workers Often Stiffed on Workers Comp Benefits, Minimum Wage

A new study released by the University of illinois at Chicago shows that wage theft is rampant among low income workers in the nation’s most populous county.

Wage theft has been a problem for a long time in Cook County, which encompasses Chicago. Experts say illegal immigrants, women, and minorities are particularly susceptible to wage theft. Employers often do not pay minimum wage, and deny workers’ compensation benefits.

The new study from University of Illinois at Chicago studied more than 1,000 workers. It shows the count loses $7.3 million each week in numerous industries because of violations of minimum wage and workers’ compensation laws. The study is called “Unregulated Work in Chicago.”

Researchers say wage theft affects at least 145,000 people in Cook County in industries like retail employees, child care, and housekeeping.

Injured Hot Air Balloon Pilot Denied Workers' Comp

A pilot of a hot-air balloon that crashed into a Vancouver-area trailer park three years ago, killing two people, has been denied workers compensation.

Stephen Pennock as the pilot of a balloon, carrying 13 people, that caught fire just before liftoff, snapped its tether and smashed down onto a trailer park. According to documents from a recent Worksafe review decision, the pilot has faced numerous problems since the incident, including burns to his body, and injuries from heat in both lungs.

Court documents show that the pilot also suffers from post-traumatic stress disorder and depression problems. Doctors say these problems are unlikely to improve until his legal issues are resolved.

The pilot told a review board that he has been living off credit cars and the sale of personal property for two years while he waited for temporary benefits to be paid. The review board, however, upheld a previous finding that the pilot had recovered from his physical injuries by January 2009.

Former Pfizer Employee Awarded $1.37M in Lawsuit

A former bio-technical scientist for Pfizer was awarded $1.37 million after being infected by a virus while working at the company and being refused workers’ compensation.

The former Pfizer employee contracted a experimental virus in the company’s laboratories. After the drug manufacturer denied workers’ compensation claims filed by the employee, the case went to court.

An intentional tort claim was dismissed by the presiding judge, and the injured worker was forced to proceed under the theory that the company had violated whistleblower laws. The ex-sceintist also alleged, in the lawsuit, that The Occupational Safety and Health Administration failed to throughly investigate the matter and take action.

$2M Companies Spend $1.58 on Workers' Comp per $100 Payroll

A study released by Marsh Inc., shows that workers’ compensation costs $1.58 per $100 of payroll at companies worth more than $200 million.

The latest edition of the Marsh report provides cost benchmarks for workers’ compensation. The benchmarks correspond to both payroll and cost of risk over two years. The cost of workers’ compensation coverage per $100 of payroll, by revenue in millions costs companies worth more than $200 million only $1.58. Companies worth more than $1 billion dollars spend only $0.84 on workers’ compensation coverage, according to the study.

In the most recent Marsh report, more than one-third of workers in the United States purchased guaranteed-cost programs. Guaranteed-cost programs are usually skewed toward small businesses, which may not have the resources to effectively manage loss-sensitive programs.
