Man Jailed for Workers' Comp Fraud

In El Paso, Texas, a former US Postal worker was sentenced to 10 months in federal prison for workers' compensation fraud. The man fraudulently alleged an on the job injury to his arm in order to receive payments.

In addition to the 10 month sentence, the man must also pay $54,851.30 in restitution as well as a $1,400 special assessment to the Crime Victims Fund. After his release he will also have to undergo 3 years of supervision.

Workers' Comp Suit Dismissed

A lawsuit against AIG alleging that the company underreported workers' compensation premiums has been dismissed by a federal judge. The suit claimed that AIG underpaid residual market assessments for several decades.

NCCI Holdings brought the suit against AIG, saying that it was excluded from a $300 million settlement in 2007 involving the same allegations. The judge in the case ruled that NCCI did not have the standing to sue on behalf of its members.

Man Gets 5 Years for Workers' Comp Fraud

On Thursday, a judge ordered a Scranton, Pennsylvania man to pay restitution for the workers' compensation benefits he fraudulently collected. The money amounted to nearly $650,000.

The man was also sentenced to 5 years and 10 months in prison. Judges often penalize cases like these harshly because they hurt workers who have legitimate compensation needs.

Possible 22.8% Rate Increase for California Workers' Comp

The Workers' Compensation Rating Bureau of California has said that it will recommend a 22.8% increase to workers' compensation premium rates across the state. If approved, the increase will go into effect on January 1.

Rising medical expenses were cited as a reason for the recommendation. However, Insurance Commissioner Steve Poizner has said that insurance providers are inefficient in controling costs and that the last recommended increase was unnecessary.

Hartford to Refund Workers' Comp Profits

Hartford Financial Services Group Inc will refund $48.2 million to Florida residents who have workers' compensation policies with them because it obtained excess profits.

The company's profits from workers' compensation between 2004 and 2006 exceeded the maximum that Florida law allows. It did not say how it will disperse the money.

Workers' Comp Fund Recovers $6.5 M

Phoenix Fund Inc was ordered into rehabilitation in October 2006 after being a victim of a $20 million reinsurance scheme. The broker responsible for the fraudulent scheme pleaded guilty in 2008 to mail fraud and money laundering. He was sentenced to 70 months in prison.

Since being put into rehabilitation, Phoenix Fund has recovered nearly $18 million. $6.5 million of that will go back to 661 former members of the fund. Employers who were members of the fund on October 17, 2006 will receive distribution checks to reimburse them for their false workers' compensation insurance.

Worker Discharged after Filing for Workers' Comp

In Madison, Wisconsin, a man has filed a suit against his former employer for wrongful termination. The man began working for the company in 1993 and injured himself on February 6, 2008.

On August 11, the man was fired after filing for workers' compensation. He is seeking over $50,000 for lost wages, benefits and other incurred costs caused by his termination.
