Roofer Guilty of Workers' Comp Fraud

The owner of Gulfstream Roofing in Florida has pleaded guilty to workers' compensation fraud. The man used fake construction companies to avoid paying around $400,000 in workers' compensation premiums.

The fraud occurred between 2002 and 2006 when the avoided paying premiums on $3 million of payroll by pretending to pay insured contractors. The owner will serve 5 years probation and will have to pay restitution totaling around $406,500.

$70K Awarded in Workers' Comp Case

A New Jersey woman injured her knee while on the job at the County of Hudson Department of Corrections. Her injury required surgery to fix and she was disciplined under suspicion of faking her injuries.

The woman filed a complaint under the Law Against Discrimination and the New Jersey Workers' Compensation Act. On July 2, a jury found in her favor and awarded her $70,000 for emotional and economic damages.

NJ Company Has Trouble with Workers Comp Insurance

A New Jersey non profit organization that contracts teachers to work overseas has been going through a legal battle over workers' compensation insurance for the last few years.

The company's insurance carrier denied it voluntary coverage for overseas employees in 2003. It was then denied assigned coverage as well. The company sued in 2006 to obtain coverage and was told that the insurance was required. Recently, however, an appeals court rescinded that ruling.

Niagara Falls Man Charged for Workers' Comp Fraud

A man in Niagara Falls, New York has been charged with workers' comp fraud after receiving more than $6,000 over the course of about a year while he was working. He is charged with grand larceny, perjury and insurance fraud among other things.

The man fractured his left foot in 2004 while working for a home remodeling company. He was found to have a permanent partial disability and signed documentation saying he had not returned to work.

CT Worker Wins Compensation Case against Pfizer

The Connecticut Appellate Court is expected to officially release its decision on a workers' compensation case on July 21. The case involves a man who developed asthma from working as a chemical operator for Pfizer.

The man's exposure to organic molds led him to develop asthma in 2002. Pfizer has since denied him workers' compensation. However, the court's ruling will have Pfizer pay a large sum upfront and cover future out of pocket medical expenses for the man.

Montana's High Workers' Comp Costs

The National Council on Compensation Insurance has reported that Montana has some of the highest workers' compensation costs in the nation. The council recently presented its findings to the state's Senate Economic Affairs Interim Committee.

On average, a workers' compensation claim costs $40,000 in Montana as compared with $24,000 in other areas. This could lead the Senate panel to form new legislation addressing these costs.

Wyoming Raises Workers' Comp Benefits

Wyoming has raised its workers' comp benefits for the first time in two decades. Survivors of workers killed on the job will now receive better benefits after two years of testimony and public complaints about the system.

In addition, there will be a cost of living adjustment for people on disability and people in contested cases will continue to receive benefits until the case is resolved.

Continental Offers Workers' Comp

Continental Risk Insurance Services has started offering workers' compensation coverage for hundreds of different classes that are generally not covered by their employers.

Workers' Comp Medical Payments Up in CA

California's workers' comp system has seen an increase in medical costs for claims. This increase came shortly after the system underwent reform in 2004.

A study showed that there was a 23% increase in the average medical payment for workers' comp claims between 2005 and 2007. Those payments went from about $2,100 to $2,582.
