Penalties for Workers' Comp Infractions Determined by Law

In a recent case, the court ruled that penalties for workers' compensation infractions must be imposed by law rather than the court's own discretion. This ruling came in the wake of a previous workers' compensation case.

The initial case involved a worker suing a car wash for a slip and fall injury. The worker won the case but it was found that the employer had never purchased workers' compensation benefits. The initial ruling had the penalty assessed from the date of injury. However, that was later changed to penalize the company for all the time spent without coverage.
