EEOC announces new definitions for disability
Last month, the Equal Employment Opportunity Commission announced new standards for what defines temporary and permanent disability under the Americans with Disabilities Act Amendments Act. The new regulations specify who qualifies under the 2008 amendment to the original Americans with Disabilities Act created in 1990.
The EEOC created the new regulations to make it easier for individuals to determine if they qualify under the “regarded as” disability definition. In addition, the EEOC released a written statement saying, “Under the new law, the focus is on how the person was treated rather than on what an employer believes about the nature of a person’s impairment.”
Despite the new regulations, the ADA’s original definition of a disability as “a physical or mental impairment that substantially limits one or more major life activities” remains.
